Monday, January 14, 2008

PRESENT: Craig Nelson, Chairman & WEO; Thomas Sarsfield, VC and Rita Foss, Secretary. MEMBERS: Nancy Binns, Henry Brau and Cindy Shook.
VISITORS: Brian Neff

MINUTES:
The minutes of the Regular Meeting of December 10, 2007 were approved on a motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

APPLICATION: (Consider)
PERMIT #08-1-1: Brian Neff/Agent; Susan Leavitt/Diego Orlanski: Applicant/Owners; 68 Hopkins Road, Warren: Porch Additions to existing house and regrading north of house. A motion was made to Grant the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

OTHER BUSINESS:
A.) Passed out to members a copy of the Meeting Dates for 2008.
B.) Information on a Workshop: Roles & Responsibilities of Land Use Commissioners, January 29, 2008 – Goshen Town Hall.
C.) Craig Nelson commented that Nancy & Duncan Haimerl have done work in a regulated area without the necessary permits. Craig Nelson has tried to get them to get a permit since May 1, 2007. Craig Nelson is requesting a Notice of the wetlands violation be recorded with their deed in the Town Clerk’s Office. The property is shown on the town assessor’s map #26, Lot #8 and located at the intersection of Brick School Road and North Kent Road, Warren, CT. A motion was made by Thomas Sarsfield, seconded by Nancy Binns to attach a Notice of Violation to their deed. Passed unanimously.
D.) Warren’s Conservation Commission received a letter from the State of CT. Department of Environmental Protection approving the Application dated 11/29/07, including plans prepared by Roald Haestad, Inc., and entitled “Shepaug and Peters Dam Modifications for Flow Monitoring”. The site is located in the Towns of Litchfield and Warren. Letter submitted to the file.

A motion was made to adjourn the meeting at 7:07 p.m. motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

The Warren Plan Committee will hold its regular monthly meeting at 7 pm, Wednesday, February 13, at Warren Town Hall to discuss the draft of “Booklet #5 - Development Issues” to be included in the Town Plan of Conservation and Development. Booklet #5 issues include the Warren town center and residential development.

Board of Assessment Appeals Schedule

The regular meeting of the Warren Board of Assessment Appeals is as follows:

March 22, 2008, 9:00 AM - review of applications to appeal real estate, motor vehicles and personal property for the Grand List as of October 2007.

The BAA hearings will be held on April 5, 12, and 19, from 9-5, by appointment.

September 20, 2008, 9:00 AM - review of applications to appeal motor vehicles only.

A Public Hearing will be scheduled for Saturday, September 20, 2008 at 9:00 AM to hear appeals for motor vehicles only.

The minutes of the Regular Meeting of 11/13/07 were approved on a motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

APPLICATIONS: (Consider)
PERMIT #07-12-1: Elizabeth Franz, Applicant/Owner; 203 Brick School Road, Warren: Removal of silt from pond mouth. Nancy Binns excused herself at this time.
The Commission received a letter from Elizabeth Franz dated 12/9/07 authorizing Christopher Pelham to act as her agent for the above application. A motion was made to Approve the Application per description on the 5th page of the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.
Nancy Binns returned to the meeting.

PERMIT #07-12-2: Adil Mulla, Applicant/Owner; 164 Melius Road, Warren: Pole Shed – 16’ x 24’. A motion was made to Approve the Application, motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

PERMIT #07-12-3: Kenneth & Gail Yocis, Applicant/Owners; 126 Kent Road, Warren: Deck in rear of house – 12’ x 16’. A motion was made to Approve the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

APPLICATIONS: (Receive)

The Applicant did not fill out the State Form. Brian Neff submitted new maps dated 11/29/07. A motion was made to Receive the Application, motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously. A motion was made to Accept the Application pending State Form to be filled out by the Applicant, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

OTHER BUSINESS

A.) For reference only the Commission received Shepaug Infrastructure Improvements project/Contract No. 1 for Shepaug and Peter’s Dams/Modifications for flow monitoring. Information submitted to the file.

B.) Craig Nelson, Chairman & ZEO along with Paul Szymanski from Howland Associates walked the property at: 35 Kent Road, possible subdivision on 9 acres.

At this time Henry Brau asked the Commission why we don’t make our minutes available to Warren’s web site – per request of Paul Frank – President of the Lake Waramaug Association. After much discussion on this request, a motion was made to put on the web site the Approved minutes, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

A motion was made to adjourn the meeting at 7:27 p.m. Motion made by Thomas Sarsfield, seconded by Nancy Binns and unanimously approved.
