Conservation Commission Minutes 3-24-08

Wednesday, April 30th, 2008

PRESENT: Craig Nelson, Chairman & WEO, Thomas Sarsfield, VC and Rita Foss, Secretary. MEMBERS: Henry Brau and Nancy Binns. VISITOR: Dave Wilson.

MINUTES:
The minutes of the Regular Meeting of 2/11/08 were approved on a motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

APPLICATIONS – (Consider)
A.) PERMIT #08-3-1: Gary Nurnberger/Scott Pools, Applicant/Agent; Margaret Griner/Owner; 41 Arrowpoint Road, Warren: 8’ x 12’ Guinite Spa. A motion was made to Grant the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

B.) PERMIT #08-3-2: Kelly & David Williams, Applicant/Owners; Dave Wilson/Agent; 149 North Shore Road, Warren: Clear under story & invasives. A motion was made to Grant the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

APPLICATIONS – (Receive)
A.) Duncan & Nancy Haimerl, Applicant/Owners; 102 Brick School Road, Warren: Improvements of existing building. This Application is an After the Fact Application. A motion was made to Receive the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously. A motion was made to Accept the Application, motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

B.) Kelly & David Williams, Applicant/Owners; Dave Wilson/Agent; 149 North Shore Road, Warren: Demolish & Rebuild Boathouse & Deck. A motion was made to Receive the Application, motion made by Henry Brau, seconded by Nancy Binns. Passed unanimously. A motion was made to Accept the Application, motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

A motion was made to add Christopher Leviness’ Application to the Agenda: Motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

PERMIT #08-3-3: Christopher Leviness, Applicant/Owner; 15 Lake Road, Warren: Septic Field Repair – Raise the Tank. A motion was made to Approve the Application pending T.A.H.D. Approval, motion made by Thomas Sarsfield, seconded by Nancy Binns. Passed unanimously.

OTHER BUSINESS:
A.) Aquatic Pesticide Permit Applications were submitted to the File.
RE: Prindle Pond, 215 Cornwall Road, Warren, CT.
RE: Robert Berne, Willow Point Pond Outlet, 8 North Shore Road, Warren, CT.

B.) Any other Regular Business Items: No new items discussed at this time.

Plan of Conservation & Development Meeting

Monday, April 7th, 2008

The Warren Plan Committee will meet at 7 p.m., Wednesday, April 9, at Warren Town Hall (lower level) to continue to work on the Warren Town Plan of Conservation and Development. The committee will review “Booklet #6 - Infrastructure Strategies,” which discusses community services and facilities, including town buildings and facilities, recreational facilities, transportation and road systems, trails and walkways and utility services.

The minutes of the Regular Meeting of 1/14/08 were approved on a motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

APPLICATIONS: (Consider)
PERMIT #08-2-1: William Gawel, Applicant/Agent; Dan Lago/Owner; 34 Kent Road, Warren: Emergency Septic Repair. A motion was made to Receive the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously. A motion was made to Accept the Application, motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously. A motion was made to Grant the Application motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.

APPLICATIONS: (Receive)
A.) Gary Nurnberger/Scott Pools, Applicant/Agent; Margaret Griner/Owner; 41 Arrowpoint Road, Warren: 8’ x 12’ Gunite Spa. Mr. Nurnberger was present at the
Meeting to discuss the plans for the proposed spa. The spa will be attached to the house with a cartridge filter to present backwashing. He also mentioned that a silt fence will be put down. A motion was made to Receive the Application, motion made by Henry Brau, seconded by Thomas Sarsfield. Passed unanimously. A motion was made to Accept the Application, motion made by Henry Brau, seconded by Thomas Sarsfield. Passed unanimously.

OTHER BUSINESS:
A.) Copy of the Notice of Violation sent out to Nancy & Duncan Haimerl dated 1/16/08 from Craig Nelson. Letter submitted to the file.
B.) Letter in response to the Notice of Violation from Nancy Haimerl dated 1/24/08. Letter submitted to the file.
Nancy Haimerl will be contacting T.A.H.D. and will then be getting back to Warren Conservation Commission.
C.) Letter sent out to Robert Richardson from Craig Nelson, dated 1/29/08.
RE: Stone Foundation with a trellis over the electric service. Both of the stone walls fall within the 100’ regulated area from the lake. A permit from the Wetlands Commission would be necessary. Letter confirming phone conversation from Craig Nelson, Chairman. Letter submitted to the file.
D.) Copy of a letter to Southview Builders RE: 208 Kent Road, Warren dated 2/7/08 from Craig Nelson. Driveway has been filled with old construction debris; this material in a wetland or regulated area is a violation of the Wetlands Regulations under Connecticut State Statutes 22A. Also, when putting in the driveway the spring was cut into. Letter confirming phone conversation from Craig Nelson, Chairman. Letter submitted to the file.
E.) Copy of the fall 2007 Habitat was passed out to members of the Commission.

CORRESPONDENCE:
A.) Received a Membership Application Form from the CT. Association of Wetlands Scientist; along with information on the 2008 CAWS Annual Meeting scheduled for Tuesday, February 26, 2008: Registration Form attached.
Craig Nelson, Chairman will check into this through their website to see if this Commission would benefit from becoming a member.

A motion was made to adjourn the meeting at 7:19 p.m. Motion made by Thomas Sarsfield, seconded by Henry Brau. Passed unanimously.
